JUSTICE BIRENDRA KUMAR ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 353/332/307 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. Allegation is that a mob was firing against police and was pelting stones just to create obstruction in the discharge of the duty of the police. The petitioner was identified as member of the mob.

Submission is that no injury was caused to anyone and the petitioner has been named only on suspicion. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.18357 of 2017 (2) dt.19-04-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka/Successor Court, in connection with Bandhua Kurawa P.S. Case No.2 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
