The Petitioner seeks bail in Awtarnagar P.S.
Case No. 28 of 2017 instituted for the offence under Section(s) 30(a)/38, 41 of the Bihar Prohibition and Excise Act. It is alleged that total 135 litres of foreign liquor were recovered from a vehicle which was driven by this petitioner. The petitioner is said to be in custody since 12.03.2017.
It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the
Patna High Court Cr.Misc. No.16968 of 2017 (2) dt.27-04-2017 2/2 Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, XI, Saran at Chapra in connection with Awtarnagar P.S. Case No. 28 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. The petitioner will file an affidavit before the lower Court that he will not indulge in such type of activity in future, otherwise his bail bonds shall be liable to be cancelled by Court below.
