The petitioner seeks bail in Surajpura P.S. Case No. 132 of 2020, registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

It is a case of dowry death. Petitioner is father-in-law of the deceased.

It is submitted on behalf of the petitioner that thrust of allegation is against husband of the deceased who is already in custody. Petitioner is father-in-law of the deceased and he is living separately and has no concern with the family affairs of the deceased and her husband. There is general and omnibus allegation. Petitioner is in custody since 09.09.2020 having no

Patna High Court CR. MISC. No.21249 of 2021(4) dt.19-01-2022 2/2 criminal antecedent. Investigation is complete. Counsel for the Informant however vehemently opposed the prayer for bail and submitted that petitioner is also alleged to have demanded dowry and committed murder of the deceased.

Considering the facts and circumstances of the case and the fact that petitioner is father-in-law of the deceased and there is general and omnibus allegation, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Surajpura P.S. Case No. 132 of 2020.
