ANJANA MISHRA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners submits that though the petitioner is not named in the First Information Report, the name of the petitioner has surfaced in the confessional statement made before the Police by one of the co-accused persons which has no evidentiary value. It is further submitted that the petitioner is an agnate with whom the informant and the deceased had some land dispute.

Patna High Court Cr.Misc. No.4331 of 2016 (4) dt.20-06-2016 P2/2 Considering the aforementioned facts and circumstances and that the petitioners have got no criminal antecedent, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai (Town) P.S. Case No. 112/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
