The petitioner is in custody since 26.10.2016 in connection with Hathauri P.S. Case No. 106 of 2016 registered for the offences punishable under sections 379 and 461 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case, he is not named in the First Informant Report, no recovery of any incriminating articles has been made from his possession, he has clean antecedent and in paragraph 40 of the case diary it has come that theft had been committed by co-accused Tajuddin, who has already been granted regular bail by a co-ordinate Bench of this

Patna High Court Cr.Misc. No.10123 of 2017 (4) dt.01-05-2017 2/2 Court in Cr. Misc. No. 11743 of 2017 on 11.04.2017. Having considered the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub-Judge-X, Muzaffarpur in connection with Hathauri P.S. Case No. 106 of 2016.
