The petitioner seeks bail in Kasim Bazar P.S. case no. 68 of 2016 for the offence under Section 379 of Indian Penal Code.

It is alleged that Pulsar motorcycle of the informant was stolen by some unknown persons at Munger Ultrasound centre situated at Pipalpanti road and in CCTV footage, unknown person was seen carrying the motorcycle. It is submitted on behalf of petitioner that he has falsely been implicated in this case.

Learned APP has submitted that the name of the petitioner was disclosed by Md. Safiullah in para 69 of the case

Patna High Court Cr.Misc. No.4983 of 2017 (3) dt.24-03-2017 2/2 diary in his confessional statement. Learned APP has further submitted that from the case diary, it appears that the stolen motorcycle was not recovered from possession of this petitioner. Considering the aforesaid facts and circumstances of the, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. case no. 68 of 2016 subject to the condition that both the bailors will be the close relatives of the petitioner.
