The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 332, 323, 307, 353, 427, 379 of the Indian Penal Code.
The prosecution case is that the informant being S.I. of police during patrolling found some persons were gambling. Subsequently, a dead body of Saddam Alam @ Sonu was recovered from a pond, when the mob including these petitioners after seeing the dead body started pelting stones on police personnel.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.4770 of 2016 (2) dt.04-02-2016 petitioners that the victim died due to assault made by the police and police in order to save their skin lodged the present case and no U.D. case has been lodged.
Considering the accusation against the mob, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Raxaul P.S. Case No. 270 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
