The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447, 504, 323, 341, 506, 307, 34 of the Indian Penal Code. Prosecution case is that on protest being made for destroying sand kept in front of the house of the informant wife of the informant was assaulted with bricks by the petitioner and co-accused Rakesh Kumar. The accused persons also snatched gold chain and ear ring from the wife of the informant. It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant and there is dispute with regard to some land property. Though, one sharp cut wound has been found on the head but the doctor opined that it
Patna High Court Cr.Misc. No.4351 of 2016 (2) dt.01-02-2016 2/2 may be grievous. It is alleged that two persons assaulted with bricks but only one injury has been found. Petitioner is 70 years of age and having no criminal antecedent, a statement to that effect has been made in paragraph 3 of the petition. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Kahalgaon P.S. Case No.499/2015, pending before the learned CJM, Bhagalpur. With the above observation, this application is, accordingly, disposed off.
