In this case, the petitioner is seeking anticipatory bail in connection with Deoriya P.S. Case No.77 of 2017, registered for the offence punishable under Sections 363, 365/34 of the Indian Penal Code.

The informant has lodged the FIR alleging therein that he has received information from his wife that Sanjit Kumar, son of the petitioner has kidnapped the daughter of the informant with the help of his associates. From the order sheet, it appears that the statement of the victim girl has been recorded under Section 164 of the Code of Criminal Procedure, in which she has stated that Sanjit Kumar has taken her from her house

Patna High Court CR. MISC. No.16815 of 2019(2) dt.26-03-2019 2/2 and thereafter he went to Patna and then to Surat where he solemnized marriage in a temple. She disclosed her age to be 14 years and the medical board has assessed her age as 16-17 years. Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Deoriya P.S. Case no.77 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
