The petitioner seeks bail in a case registered under Sections 147, 149, 323, 325, 307, 504, 506 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the informant by means of khanti, iron rod, mungri, due to which he sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.11.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.9127 of 2020(2) dt.04-03-2020 2/2 in the present case. Single iron blow is alleged to have been given to the victim by the petitioner. There is no repetition of blow. The petitioner had no intention to commit murder of the victim. It is further submitted that the petitioner may be released on bail after completion of six months in custody from 09.11.2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of six months in custody from 09.11.2019 on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Kundwachainpur P.S. case No.149 of 2019.
