====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in connection with Sessions Trial No. 183 of 2018 arising out of Kajra P.S. Case No. 42 of 2018, instituted for the offence under Section(s) 364 of the Indian Penal Code. Subsequently, Section 302/34 of the Indian Penal Code was added.

In the written report it is alleged that on the date of occurrence husband of the informant had gone to his jewelry shop and did not return. During search, the informant found the lock of jewelry shop opened. The informant has raised suspicion against unknown persons of kidnapping her husband with Motorcycle.

Counsel for the petitioner submits that First

Patna High Court CR. MISC. No.11494 of 2019(2) dt.26-02-2019 2/2 Information Report is against unknown. He further submits that name of petitioner has come during investigation in the confessional statement of co-accused Gagan Kumar Paswan. It is mentioned in paragraph-3 of the bail petition that petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I-cum-Special Judge, Lakhisarai, in connection with Sessions Trial No. 183 of 2018 arising out of Kajra P.S. Case No. 42 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
