1. Heard learned counsel for the petitioner and learned A.P.P. for the State. bbhn

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 143, 341, 342, 323, 436 and 429 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and has been falsely implicated in the instant case by the informant with general and omnibus allegation. It is next submitted that specific allegation of sprinkling diesel on the house of the petitioner is against Birendra and Govardhan Yadav is alleged to have ignited the fire and as far as this petitioner is concerned, he is alleged to have been a member of the mob. It is further submitted that petitioner is not related to Birendra or Govardhan Yadav in any manner.

4. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.13563 of 2024(5) dt.02-07-2024 2/2 anticipatory bail of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Wazirganj P.S. Case No. 45 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. However, the petitioner at the time of surrender shall submit his genealogical table showing that he is not related either to Birendra or Govardhan Yadav.

7. It is further made clear that in the event if such genealogical table is not filed at the time of surrender, the present anticipatory bail order shall not be given effect to. (Satyavrat Verma, J) Rishabh/- U T
