IN THE HIGH COURT OF JUDICATURE AT PATNA
Civil Writ Jurisdiction Case No.9040 of 2015 ====================================================== Mahesh Prasad son of Late Santo Lal resident of mohalla Belan Bazar behind Baidnath Talkies Police Station Kasim Bazar Post Office - Munger District Munger ..... .... Petitioner
Versus
1. The State of Bihar through the Principal Secretary-cum-State Transport Commissioner Department of Transport, Govt. of Bihar, Patna.
2. The Principal Secretary-cum-State Transport Commissioner-cum-State Transport Commissioner, Department of Transport, Govt. of Bihar, Patna .... .... Respondent ====================================================== Appearance :
For the Petitioner : Mr. Bindhyachal Singh, Advocate For the Respondents : Mr. Vivek Anand Amritesh, AC to SC 28 ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 23-07-2018 Learned counsel for the petitioner, in presence of learned counsel for the State, makes a limited grievance that his service appeal dated 31.10.2012 is pending before the Appellate Authority till date.
Learned counsel for the State submits that petitioner's appeal is barred by limitation.
This Court is not going into the merits of the appeal. Since a limited prayer is made by learned counsel for the petitioner for disposal of his appeal, whatsoever may be the decision, it is only appropriate that the Appellate authority should take a final decision on the petitioner's appeal. Pendency of appeal for such a long period is wholly undesirable. It is, therefore, expected that the Appellate authority shall take a final decision in the matter expeditiously.
The writ petition is disposed of.
