JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-05-2019 This is an application for grant of anticipatory bail in connection with Chautham P.S. Case No. 215 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code.

Allegation as per F.I.R. is that while the petitioner was plaughing his field, the same was objected by the father of the informant, on which the petitioner thrashed the father of the informant on the ground due to which he died. Submission of learned counsel for the petitioners is that the whole allegation is false and concocted and the same has been levelled due to land dispute and previous enmity and postmortem report clearly shows that there is no external injury and the petitioners have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in connection with Chautham P.S.
