JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 The petitioner is in custody since 16.02.2017 in connection with Bihra P.S. Case No. 108 of 2016, registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 448, 427, 504, 506 with later on added Section 302 of the Indian Penal Code.
Allegation against the petitioner is that he is also one of the accused persons, who assaulted the informant's husband. It has been submitted on behalf of the petitioner that petitioner is not at all involved in the alleged offence, he was only present with other co-accused persons at the place of occurrence. Further no allegation of assault or any specific overt has been levelled against the petitioner. Petitioner has no criminal antecedent and has been in judicial custody since 16.02.2017 and other co-accused has already been granted bail by this Court vide
Patna High Court Cr.Misc. No.17236 of 2017 (2) dt.17-04-2017 2/3 order dated 18.03.2017, passed in Criminal Miscellaneous No. 7824 of 2014.
Learned counsel for the State could not controvert the above submissions of learned counsel for the petitioner. Having heard both sides, considering the facts and circumstances of the case and also other co-accused has already been granted bail by this court and petitioner has no criminal antecedent and has remained in judicial custody for more than two months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Saharsa, in connection with Bihra P.S. Case No. 108 of 2016, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and
