JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Supaul P.S. Case No.654 of 2019 registered under Sections 341, 323, 379, 354, 384, 504 and 506 of the Indian Penal Code. The accusation is that the informant Punam Kumari was staying at her Maika for the last four months. On 29.09.2019, the informant returned from her Maika and reached at her residence at about 07.00 P.M. Thereafter, when the informant opened the lock of the main gate of her house and flashed torch light, then saw that the petitioner, after breaking the lock of the grill, was breaking the lock of the house, whereas his wife Samtoliya Devi was spreading the pieces of the electric

When the informant reached near the petitioner, then the petitioner folded the Gamchchi on her neck and, with an intention to kill her, started pressing her neck, torn her blouse, pulled her saree and started causing assault through fists and slaps. At that time, Samtoliya Devi, the wife of the petitioner, laid down the informant on the ground by catching her hair and snatched the gold earring from her ear and this petitioner snatched the purse from her shoulder containing cash Rs.9000/- and other articles and fled away. Learned counsel for the petitioner submits that the petitioner and the informant are next door neighbour. In fact, the petitioner had filed Complaint Case No.866C of 2019, on which basis Supaul P.S. Case No.

05 of 2020 was lodged, regarding the kidnapping of his daughter against the informant of the present case and others, due to that reason, the informant has lodged the present case against the petitioner and others. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.
