The petitioners apprehend their arrest in Kopa P.S. Case No. 145 of 2016 instituted for the offence under Sections 147, 148, 149, 332, 342, 353, 307, 379, 511 of the Indian Penal Code, Sections 30, 37 of Bihar Excise Act and Section 27 of the Arms Act.

It is alleged in the written report that in Barat party, the police found three persons taking wine by the side of the road and when the police chased them members of Barat party and other three persons along with 40-50 members of Barat party surrounded the police force and attacked on them. They threw down the Hawaldar Nand Kumar and assaulted the police party

Patna High Court Cr.Misc. No.10606 of 2017 (2) dt.09-03-2017 2/2 with fists and leg causing bleeding from nose and mouth of the informant. They were also making firing from the rifle. The police party informed SHO Revilganj P.S. who arrived and apprehended eight persons as named in the written report. It is alleged that petitioners No. 1, 2, 3 were members of bride side managed to run away. It is further mentioned in the written report that the apprehended persons disclosed the name of some persons including the petitioner No. 4.

In this manner, mere suspicion has been raised against the petitioners in the written report. Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Kopa P.S. Case No. 145 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra at Saran, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
