JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioners who are father and son respectively and in custody since 01.01.2020, seek bail in connection with Bhagwan Bazar P.S. Case No. 1 of 2020 instituted for the offences under Sections 30(a), 37(c) of the Bihar Prohibition & Excise Act, 2016. It appears that 40 litres of country made liquor was found beneath the cot in the house of the petitioners.

The learned counsel for the petitioner submits that both father and son have been implicated in this case because of some ulterior purposes.

Considering the aforestated facts particularly the period of custody and the clean antecedents, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousands) each with sureties of the like amount each to the satisfaction of learned Additional Sessions Judgecum-Special Judge, Excise, Saran in connection with Bhagwan Bazar P.S. Case No. 1 of 2020.
