Writ petition was filed challenging memorandum of charges dated 2.11.2015( Annexure 5).

It is submitted by learned counsel for the petitioner that during pendency of the writ petition final order of punishment dated 28.2.2016 has been awarded. He submits that in view of the events subsequent to filing of the writ petition he seeks permission to withdraw the writ petition with liberty to assail order of punishment in appeal before the Appellate

Writ petition is permitted to be withdrawn with the liberty aforesaid.

Order of punishment is dated 28.6.2016. Since the writ petition was pending during all this while, this Court would observe that time spent in the instant proceeding would not be held against the petitioner as delay by the Appellate Authority if the appeal is filed by him within two weeks from today.
