Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 and 120B of the IPC, Sections 25(1-b)a, 26 of the Arms Act, Section 47(A) of the Excise Act and 47(F)/53 (A) of New Excise Act, 2016.

As per prosecution case, it is a case of recovery of some arms and ammunition from the possession of the accused persons. Learned counsel for the petitioner submits that there is no recovery from the possession of this petitioner. He further submits that similarly situated co-accused has already been granted bail by this Court passed in Cr.Misc.No.36865 of 2016 vide order dated 05.09.2016 and the petitioner is in custody since 24.05.2016.
