The petitioner apprehends her arrest in connection with Banka P.S. Case No.204 of 2021, registered for the offences punishable under Sections 353, 427 and 34 of the Indian Penal Code and Sections 4/6/10 of Bihar Conduct of Examination Act, 1981.

The informant alleges that on 21.03.2021, during examination of Bihar Police Constable, candidates bearing Roll No.414030430, 442 and others had thrown their question papers and had torn their O.M.R. sheets and even created ruckus at the Centre.

Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.13286 of 2023(2) dt.29-04-2023 2/2 present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that similarly situated coaccused has already been enlarged on anticipatory bail by a coordinate Bench of this Court vide order dated 06.12.2022, passed in Cr. Misc. No.38808 of 2022.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforessaid, let petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.204 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
