Mr.Mritunjay Kumar Nirala ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Hilsa P.S. Case No. 489 of 2019 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 153 liters of country made wine from a bush besides the Road. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent.

In the facts and circumstances of the case, I am

Patna High Court CR. MISC. No.9163 of 2020(2) dt.29-02-2020 2/2 inclined to grant anticipatory bail to the petitioner, subject to the condition that the petitioner is agreed to deposit Rs.20,000/- (twenty thousand) in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Aditonal District Judge-III-Cum-Special Judge, Excise, Nalanda at Biharsharif in connection with Hilsa P.S. Case No.489 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
