JUSTICE SANJAY PRIYA ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sherghati (Dobhi) P.S. Case No. 58 of 2015 instituted for the offence under Sections364(A), 120(B)/34 of the Indian Penal Code and under Section-17 of CLA Act.

It has been submitted that this petitioner has been named in the written report merely on suspicion. The two abducted persons namely, Akhilesh Kumar Verma @ Akhilesh Kumar and Surendra Kumar Yadav have made their statement u/S 164 of the Cr.P.C. in which, they did not name the petitioner. One of the accused Anup Yadav whose name has been taken by the informant along with others in the written report, has already been admitted to bail by a coordinate bench of this court vide order dated 15-10-2015 passed in Cr. Misc. No. 46971 of 2015.

Learned APP did not controvert the submission and stated that both the victim after their recovery in their statement u/S 164 of the Cr.P.c. did not level any specific allegation of overt act against the petitioner.

Considering the above-said facts and circumstances of the case as well as submission of the parties, this bail petition is allowed and it is ordered that let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sherghati (Dobhi) P.S. Case No 58 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghati , Gaya subject to condition that both the bailors should be close relatives of the petitioner.
