04-03-2020 Heard learned counsel for the parties.
The petitioners apprehend their arrest in Yogapatti (Sanichari) P.S. Case No. 230 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code and Section 3/4 of Dian Act (Witchcraft Act). In the FIR, it is alleged that due to dispute between the children of both the parties, scuffle took place, in which, all the accused persons, including petitioners, assaulted the informant and her daughter.
Patna High Court CR. MISC. No.12948 of 2020(2) dt.04-03-2020 2/2 It is submitted on behalf of petitioners that as per injury report (Annexure - 2), the injury has been found to be simple in nature. It is further submitted that both parties are neighbour and due to some quarrel between the children of the parties, some marpit took place. Petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Yogapatti (Sanichari) P.S. Case No. 230 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay U T
