JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2020 The petitioner seeks regular bail in connection with Ahiyapur P.S. Case No. 1379 of 2019, registered for offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Prosecution case is that police on information that some miscreants have assemble and are planning to commit dacoity, raided the place and arrested five accused persons including petitioner and there is recovery of one loaded country made pistol from the possession of the petitioner and there is also recovery from other accused persons. Apart from that he is accused in other cases also.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and has been in custody since 20.11.2019.

Patna High Court CR. MISC. No.8888 of 2020(2) dt.03-03-2020 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the allegation as well as criminal antecedent of the petitioner, at this stage, I am not inclined to enlarge the petitioner on bail, however, once the charge is framed or petitioner completes six months in judicial custody, whichever is earlier, the petitioner will be at liberty to renew his prayer for bail.
