The petitioner seeks regular bail in connection with Dumraon P.S. Case No. 463 of 2020 instituted for the offences under Sections 25(1-b), a, 26 and 27 of the Arms Act. Learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that the informant had alleged that when the police on information reached the house of Madan Yadav and searched the place of occurrence, one country made pistol in a bag and eleven cartridges were recovered and on inquiry, the name of this petitioner surfaced. Further, the informant also seized one TVS red colour motorcycle bearing Registration No. BR44M5028.

No.21275 of 2021(2) dt.15-11-2021 2/2 Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner rather it is alleged that on inquiry the name of the petitioner transpired and the place of occurrence from where alleged katta has been recovered does not belong to the petitioner and the petitioner is in custody since 09.12.2020. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.12.2020 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing of bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Dumraon P.S. Case No. 463 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
