The petitioner seeks regular bail in connection with Hajipur Town P.S. Case No. 476 of 2022, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner is that he alongwith other co-accused persons named in the F.I.R. has committed the murder of the son of the informant. The petitioner is father-in-law of the deceased and other co-accused persons are the family members of the petitioner. It is alleged that the daughter of the petitioner having illicit relationship with the other person and when the son of the

Learned counsel for the petitioner submits that the deceased who was son-in-law of the petitioner was suffering from mental illness as well as with other ailments and his health deteriorated and he was taken to the hospital where the deceased was declared dead by the doctor. The petitioner alongwith his family members has falsely been implicated in this case. He has further submitted that in postmortem report, no any external injury caused by assault was found on the body of the deceased. There is no eye-witness of the incident and the entire allegation is based on suspicion. The petitioner has no criminal incident and he is in jail custody since 04.11.2022. Co-accused, namely, Tetri Devi and Rajeev Kumar have already been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 21.12.2022 and 23.12.2022 in Criminal Misc. No. 65595 of 2022 and Criminal Misc. No. 65579 of 2022 respectively.

Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two
