The petitioner seeks bail in connection with Hajipur Town P.S. Case No.9/17 registered under Sections 363, 365, 366(A)/34of the Indian Penal Code.
The accusation against the petitioner is of kidnapping of the daughter of the informant.
Learned counsel for the petitioner submits that, in fact,there was love affairs in between the daughter of the informant, Nandani Kumari, and the petitioner. He further submits that the victim herself eloped with the petitioner at her own sweet will and she voluntarily married with the petitioner and

No.12180 of 2017 (2) dt.17-03-2017 2/2 she has been living happily with him as wife and the husband which reveals from the statement of the daughter of the informant recorded under Section 164 Cr.P.C. At the time of recording her statement the learned Magistrate has assessed her age 18 years. The petitioner is in custody since 16.01.2017. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Hajipur, Vaishali, in connection with Hajipur Town P.S. Case No.9/17.
