JUSTICE MADHURESH PRASAD ORAL ORDER 22-11-2022 The writ petition has been filed for setting aside the order contained in letter dated 25.07.2018 by which the contractual employment of the petitioner has been ordered to be terminated.

The State has filed a counter affidavit. The consequential order dated 08.08.2018, whereby the petitioner's contractual services were terminated, has been brought on record.

State Counsel has taken an objection that the same has never been assailed by the petitioner, even though from the

Patna High Court CWJC No.18799 of 2018(3) dt.22-11-2022 2/2 records it appears that the writ petition has been filed after issuance of the order dated 08.08.2018.

In view of this position, the Court would observe that since the order of termination has not been assailed, no cause of action is made out in the instant writ application. The same is dismissed.
