Petitioners apprehend arrest in a case registered for the offence punishable under sections 366A/34 of the Indian Penal Code.

As per the prosecution case, these petitioners induced and enticed away minor daughter of the informant on the pretext of marriage.

Learned counsel appearing for the petitioners submits that the victim is major and out of her free will, she solemnized marriage with petitioner no.1. Now she is legally wedded wife

Petitioner nos. 2 and 3 are parents of petitioner no.1. Petitioners claim clean antecedent. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate/Successor Court, Banka in Dhoraiya Police Station Case No. 120 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
