JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Kahalgaon P.S. Case No.445/16 registered under Sections 461 and 379 of I.P.C.

The accusation is of committing theft of three Monitors, three C.P.U., three Mousses, three Key Boards and one USB Camera by unknown thieves to Computer room of Registry Office, Kahalgaon.

Learned counsel for the petitioners submits that in course of investigation the spy disclosed the name of Pintu and Kaila having hand in the theft of the Computer materials Makho

Patna High Court Cr.Misc. No.13499 of 2017 (3) dt.06-04-2017 2/2 @ Mukesh Singh was seen carrying computer materials at the house of Balvir Singh (petitioner no.3). Thereafter house of petitioner no.3 was searched from where old computer materials are said to recovered. In fact, petitioner no.3 used to work of repairing the parts of computer and the materials of computer as recovered from the house of petitioner no.3 were kept for repairing. The petitioner no.1 and petitioner no.2 are the father and the brother of petitioner no.3 respectively and they have also been implicated in this case. The petitioners are in custody since 18.12.2016.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, in connection with Kahalgaon P.S.Case No.445/16.
