JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 20-08-2018 The present writ petition has been filed for quashing the decision dated 13.09.2014 by which the selection committee has rejected the claim of the petitioner for allotment of a Fair Price Shop on compassionate ground.

2. None appears on behalf of the petitioner despite repeated calls.

3. Learned counsel for the respondent opposes the writ petition inviting reference to para 7 of the counter affidavit taking the stand that the petitioner was a married lady and hence not dependant on late Jhalki Devi, the erstwhile licence holder. The PDS licence on compassionate basis can be

Patna High Court CWJC No.18662 of 2015 dt.20-08-2018 granted to only the surviving wife, husband, son, unmarried daughter, daughter-in-law and son's widow of the licence holder and as such the petitioner was not eligible for the same.

4. Having heard learned counsel for the respondents and on consideration of the materials on record, this Court finds the writ petition to be devoid of merit. The stand in the counter affidavit that the petitioner was a married lady and was not eligible for grant of PDS licence on compassionate ground has not been controverted and no rejoinder has been filed on behalf of the petitioner. The writ petition accordingly stands dismissed.
