2. The petitioner seeks bail in connection with Bikramganj P.S. Case No. 476 of 2024 registered for the offence under Sections 80, 3(5) and 123 of BNS.

3. As per the prosecution case, the petitioner is the husband of the deceased and he is alleged to have killed the deceased.

4. Mr. D.K. Sinha, learned senior counsel for the petitioner submits that deceased has consumed poison and she has taken to the local hosptial at Bikramganj from where she was taken to NMCH, Jamuhar, Sasaram but during the course of treatment, she died.

5. It has further been submitted by the learned senior counsel for the petitioner that the petitioner has two minor children who are already with the petitioner's family. The petitioner is in custody since 8.10.2024.

6. Learned counsel for the informant has opposed the prayer of the petitioner for grant of bail and has submitted that the accused persons by giving her poison.

7. Considering the facts of the case and also considering the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram/concerned Court below in connection with Bikramganj P.S. Case No. 476 of 2024.
