Petitioner seeks bail in connection with Belhar (Khesar) P.S. Case No. 144 of 2016 registered under Section 307 and other allied sections of the Indian Penal Code. Learned counsel for the petitioner submits that similarly situated co-accused persons have been granted bail by this Court vide orders dated 02.09.2017, 08.09.2017, 20.04.2017 and 21.04.2017 passed in Cr. Misc. Nos. 16762 of 2017, 15739 of 2017, 27943 of 2016 and 36057 of 2016 respectively.
Considering the facts and circumstances of the case specially the fact that similarly situated co-accused persons have been granted bail, the petitioner above named is directed
Patna High Court Cr.Misc. No.16276 of 2017 (2) dt.27-04-2017 2/2 to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Belhar (Khesar) P.S. Case No. 144 of 2016 with conditions that (i) one of the bailors must be a local person having sufficient immovable property within the jurisdiction of the concerned Court, (ii) petitioner will not induce any witness or tamper with the evidence and (iii) petitioner shall cooperate in disposal of the trial and make himself available as and when required by the Court and in the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
