JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2018 The petitioner by way of the present writ petition has prayed for the following reliefs:- (i) To issue a writ in the nature of writ of mandamus commanding and directing the Regional Transport Authority, Darbanga to implement the Notification issued vide GSR No. 6/C.M.T.((bus Fare)-01/2014 4572 dated 26.08.2014 (Annexure-3) issued under the seal and signature of Principal Secretary cum State Transport Commissioner, Transport Department, Government of Bihar, Patna whereby and whereunder the said authority after modifying the earlier Notification issued vide GSR No. 4450 dated 10.10.2000, fixed the fare of bus service of different category and directing all the Regional Transport Authorities of Bihar to implement the same within 15 days strictly after fixing point to point fare of the bus service but the same has not been implemented by the Regional Transport Authority, Darbhanga (Respondent No. 3) till
Patna High Court CWJC No.469 of 2018(2) dt.06-09-2018 2/2 date, result of that day to day conflict are taken place between the bus operator and travelling passengers.
(ii) To direct the respondents to reconsider and revise the rate of bus fare of different categories of bus service because last revision of bus fare was made on 20.08.2014, that too, the same is not implemented till date by R.T.A, Darbhanga, but in last 4 years many changes has been taken place in the operation of bus service and as rate of different items have been increased many times, as such the revision of bus fare is also requires to be made so that bus owners who indulged in the business of transport, may not put loss in the business.
In view of the aforesaid prayer made by the petitioner in the present writ petition, it would be appropriate to dispose of the present writ petition with a direction to the Respondent No. 1 to consider the case of the petitioner on merits and dispose of the same by a reasoned and speaking order within a period of eight weeks from today.
In order to facilitate quick disposal of the case of the petitioner, the petitioner is directed to file a representation within a period of two weeks from today.
The present writ petition is disposed of on the aforesaid terms.
