The petitioner, already in custody, seeks bail in connection with Complaint Case No. 1371C of 2013 registered under Sections 498A and 494 of the Indian penal Code and under Sections 3 and 4 of the Dowry Prohibition Act. Allegation in brief is that the petitioner used to torture his wife to realize further demand of dowry. Submission is that marriage was solemnized in the year 2003 and there are two children out of their wedlock and allegation of further demand of dowry is fabricated and this petitioner is already making payment of interim maintenance of Rs. 1200/- per month as directed by the concerned Family Court
Patna High Court Cr.Misc. No.11409 of 2017 (2) dt.15-03-2017 2/2 and he has been in custody in this case since 04.12.2016. Having considered the aforesaid facts and circumstances, the petitioner, namely, Dinesh Sah, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Khagaria in connection with Complaint Case No. 1371C of 2013.
