The petitioner, who is in custody, seeks bail in connection with DGB/GRP/SMI/Rail (Darbhanga-Sitaamrhi) P.S.Case No. 91 of 2016 registered under Section 370 of the Indian penal Code and Section 16 of the Bounded Labour System Abolition Act, 1976.

Allegation in brief is that the petitioner, along with 16 boys of the village, was apprehended by the police going by a train. It is alleged that boys were being taken to the destination of being engaged in labour work.

It is submitted that the so-called boys have not made any statement against the petitioner and they were co-villagers and merely on the basis of suspicion, the petitioner has been

No.6760 of 2017 (2) dt.16-02-2017 2/2 apprehended and he is in custody since 27.10.2016 and other coaccused of this case having similar allegation have already been granted bail by a co-ordinate Bench of this Court vide order dated 07.02.2017 passed in Cr. Misc. No. 3236 of 2017 and Cr. Misc. No. 2461 of 2017 respectively.

Considering the aforementioned facts and circumstances, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.(Rail), Samastipur in connection with - DGB/GRP/SMI/Rail (Darbhanga-Sitaamrhi) P.S.Case No. 91 of 2016.
