The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code. Later on Section 412 of I.P.C. was added.

Allegation is that some unknown miscreants robbed the trailer truck which was loaded with 39.9 tone iron rod of 10 M.M.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.11.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. His

Patna High Court CR. MISC. No.9177 of 2020(2) dt.04-03-2020 2/2 name has come on confessional statement of co-accused. It is alleged that 39.9 quintals iron rod is recovered. The petitioner had no knowledge that the iron rod in question is stolen property. The petitioner has not been put on T.I.P. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Amas P.S. case No.212 of 2019.
