The petitioner seeks bail in Danapur P.S. Case No. 352 of 2016 registered under Sections 393 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Indian Penal Code.

The police got information that some persons had assembled near Takia Village. The police raided the place and apprehended four persons on chase. Illegal arms and ammunitions along with motorcycle were recovered from the apprehended accused.

Leanred counsel for the petitioner submits that one loaded country made pistol was recovered from the possession of the petitioner and for that the petitioner is in jail since

Patna High Court Cr.Misc. No.19662 of 2017 (2) dt.01-05-2017 2/2 23.08.2016. No other articles were recovered from the possession from the petitioner. Petitioner is accused in another case registered under section 379 of the Indian penal code in which the petitioner is on bail.

Considering the facts aforesaid and the fact that the petitioner has remained in jail for more than eight months for recovery of one loaded country made pistol, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur in connection with Danapur P.S. Case No. 352 of 2016.
