JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-03-2016 Heard learned Counsel for the petitioner, the State Bank of India and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Barhara Police Station Case No. 269 of 2015, disclosing offences under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code.

It is alleged against the petitioner that he got a loan worth Rs. 6,00,000/- advanced, in the name of purchase of a vehicle, by submitting fake and forged documents to the State Bank of India (Opposite Party No. 2). The allegation against the petitioner is that ne neither purchased any vehicle nor re-paid the entire loan amount,

No.6175 of 2016 (3) dt.11-03-2016 2/2 though he paid initial instalments to the tune of Rs. 1,13,000/- Considering the fact that the allegations against the petitioner are based mainly on the documentary evidence and there is no likelihood that the petitioner can tamper with such evidence, this application is allowed. Let the petitioner, Munna Gupta, in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, in connection with Barhara Police Station Case No. 269 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
