This is an application for bail in connection with Narhat P.S.Case No. 165 of 2014 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that except suspicion there is nothing against these petitioners and they are in custody for four months.

Heard learned APP and learned counsel for the informant also.

Learned counsel for the informant has submitted that deceased was seen near the wine shop of the petitioners and, as such, there is direct allegation against these petitioners and he also could not point out any other fact showing that the deceased was seen at the wine shop of the petitioners.

Having heard both sides and considering the facts and circumstances of the case, let the petitioners, above named, be

Patna High Court Cr.Misc. No.9228 of 2017 (2) dt.28-02-2017 2/2 released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Smt. Anindita Singh, Additional Judicial Magistrate- III, Nawada, in connection with Narhat P.S.Case No. 165 of 2014, corresponding to G.R.No.2600 of 2014, subject to the conditions that :- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move the cancellation of their bail.
