The Petitioner seeks bail in Khodawandpur P.S. Case No.03 of 2017 instituted for the offence under Section 39(a) of the Bihar Excise Amendment Act, 2006.

It has been submitted that this petitioner along with two other accused persons were arrested at the spot. They were present at the spot to unload the foreign liquor from the truck. It is further submitted that co-accused Saroj Kumar with similar allegation has already been granted bail by a co-ordinate Bench of this Court vide order dated 21.4.2017 passed in Cr. Misc. No. 18165 of 2017.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.13002 of 2017 (4) dt.28-04-2017 2/2 the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No. 3 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
