JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 307, 504, 506, 34 of the Indian Penal Code. The prosecution case is that the accused persons came variously armed and started abusing the informant's side when on the order of co-accused Manzar Ansari co-accused Yakub Ansari and Mustak Ansari assaulted the informant and his brother by farsa on their heads as a result of which they sustained bleeding injuries. Other accused persons also assaulted the parents of the informant. It is further alleged that co-accused Doctor Ansari committed theft of a box containing cash of rupees two lacs and cloths and ornaments. It is alleged against this petitioner that she committed theft of gold chain of the mother of the informant. It is submitted by learned counsel for the

No.4442 of 2016 (2) dt.01-02-2016 2/2 petitioner that accusation of assault has not specifically been levelled against the petitioner, though the injury has been found to be simple. It is further submitted that petitioner's side lodged a case at earlier point of time and the accusation has been levelled in the background of land dispute. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that accusation of assault has not been levelled against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S. Case No. 144 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
