This application for regular bail arises out of Jogbani P.S. Case No. 28 of 2019 corresponding to Special Case No. 03 of 2019, disclosing the offences under Sections 20, 22, 23 and 24 of the N.D.P.S. Act.

Learned counsel appearing on behalf of the petitioner has relied on an order of this Court dated 20.01.2020 passed in Cr. Misc. 73931 of 2019 whereby co-accused Sunita Bista on whose possession Ganja was recovered, has been allowed regular bail. He has submitted that as per the case of the prosecution, 7.3 Kg. of Ganja was recovered and the petitioner's name has surfaced on the basis of disclosure made

Considering the fact that other co-accused persons have been allowed regular bail by this Court, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria, in connection with Jogbani P.S. Case No. 28 of 2019 corresponding to Special Case No. 03 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
