2. The petitioner apprehends arrest in connection with Paroo P.S. Case No. 274 of 2024 instituted under Sections 103(1), 70(2), 3(5) of the Bhartiya Nyay Sanhita, 2023 and section 4, 6 of the POCSO Act and section 3(1)(x) SC/ST Act.
3. The petitioner is accused of committing rape and murder of minor girl aged about 14 years.
4. Learned counsel for the petitioner submits that petitioner is falsely been implicated in this case. Petitioner has got no criminal antecedent.
5. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.10797 of 2025(2) dt.28-03-2025 2/2 bail and submits that petitioner is accused of rape and murder of minor victim girl.
6. Considering the serious allegation levelled against the petitioner, in the opinion of the Court, it is not a fit case for grant of anticipatory bail.
7. Accordingly, the application stands dismissed.
8. If the petitioner surrenders within four weeks from today and prays for regular bail, the same shall be considered by the Court below in accordance with law without being prejudiced by the present order.
