The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, three accused persons including the petitioner herein are stated to have carried out indiscriminate firing on the uncle of the informant leading to his death.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations in the FIR are general and omnibus in nature. In course of investigation the daughter and son of the informant were examined and they have made specific allegations of firing against Choudhary Madhav @ Sunny Singh @ Hira Singh @

Patna High Court CR. MISC. No.22178 of 2021(3) dt.15-11-2021 2/2 Chandeswar Azad. The petitioner is in custody since 3.12.2019 and has no criminal antecedent Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 11 months, the Court directs the petitioner to be enlarged on bail in connection with Kalyanpur P.S. Case no. 280 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur.
