The petitioner apprehends his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
Allegedly, petitioner is said to have assaulted the informant and his associate. They looted them and fled away by the informant's Pickup Vehicle.
It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is not specific rather general and
Patna High Court CR. MISC. No.11501 of 2023(2) dt.11-05-2023 2/3 omnibus in nature. Neither he was named in the FIR nor anything has been recovered from his possession. Two case have been filed against the petitioner for the same occurrence. This case has been instituted against six unknown miscreants. His name has been transpired in this case during the investigation. He was made accused in the present case on the basis of the confessional statement of co-accused, namely, Kalendra Kumar. It is further submitted that the petitioner has already been granted bail in Chhatarpur P.S. Case No. 60 of 2022 on 13.05.2022. Petitioner has one criminal antecedent as mentioned in para-3 of this application.
Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case, as the petitioner has already been granted bail in Chhatarpur P.S. Case No. 60 of 2022, which was instituted for the same occurrence that of the present case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with
