This application is for grant of bail in connection with Buxar Rail P.S.Case No.124 of 2016 for the offence under Sections 379/411 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case due to dispute with respect to the seat and he has been falsely implicated in this case and he is of Bengal and he has nothing to do at Buxar. He is in custody for about three months.

Heard learned A.P.P. also.

Having heard both sides. From perusal of the F.I.R. it appears that the petitioner was caught red-handed at the spot itself as such, I am not inclined to grant bail to the petitioner at this

Patna High Court Cr.Misc. No.5093 of 2017 (2) dt.16-02-2017 2/2 stage, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months and if not concluded, the petitioner is at liberty to renew his prayer before the court concerned itself and the learned court below will pass appropriate order without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
