2. The petitioner is in custody in connection with Durgawati P.S Case No. 288 of 2024 registered for the offences punishable under Sections 103(1), 3(5) of the B.N.S, 2023.
3. As per prosecution case, petitioner along with coaccused have abused and assaulted the informant and his wife, due to which wife of the informant succumbed to death.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner has got clean antecedent as stated in paragraph No. 3 of the bail application. It is also submitted that petitioner is in judicial custody since 15.09.2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order, it appears that allegation against the petitioner is geneal and omnibus in nature. From perusal of the postmortem report of the deceased it appears that, doctor opined that no external injury found over the body except diffuse swelling present on the right side of the chest. Doctor further opined that cause of death is cannot be ascertained but final opinion will be given after analysis of the viscera which have been preserved.

Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J 3rd , Kaimur at Bhabua in connection with Durgawati P.S Case No. 288 of 2024.
