The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

As per the prosecution case, the accused persons are stated to have looted the informant of jewellery and cash on the point of firearm.

It is submitted by learned counsel for the petitioner that the FIR was registered against five unknown. On the basis of secret information having been received a raid was conducted and seven accused persons including the petitioner herein were caught. Confessional statement of all the accused persons were recorded. No incriminating article has been recovered from the possession of this petitioner. Inspite of the petitioner being in

Patna High Court CR. MISC. No.22120 of 2021(3) dt.15-11-2021 2/2 custody since 24.9.2020, he has not been put on T.I. parade. His case stands on a similar footing to that of other co-accused who have been enlarged on bail vide order dated 24.9.2020 passed in Cr. Misc. No. 24303 of 2020, order dated 25.6.2021 passed in Cr. Misc. No. 4841 of 2021 and order dated 23.6.2021 passed in Cr. Misc. No. 9174 of 2021.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having been put on T.I. parade and grant of bail to the above referred co-accused, the petitioner is directed to be enlarged on bail in connection with Rajnagar P.S. Case no. 58 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st Class, Madhubani.
